In plain language
- MARSA is an intermediary platform connecting shippers, carriers and service providers; we are not a carrier, freight forwarder or customs broker.
- All prices are in US dollars; local currency is an estimate only.
- You pay freight directly to the carrier: 30% at pickup and 70% after you accept proof of delivery. We never receive or hold freight money.
- We charge the shipper a 3% fee on the rate at booking (min $25, max $400) plus tax; carriers pay no fee.
- Cancellation is free up to 48 hours before pickup, then a fee is payable to the carrier.
- In disputes we help with evidence and propose a settlement; we don't issue binding rulings.
1 · Definitions
Platform, MARSA or we: MARSA's apps, website and portals, owned by [legal entity], registered in [country] under CR no. [number]. User: anyone who creates an account — shipper, carrier, owner-operator, driver, service provider or advertiser.
2 · Our role
MARSA is a technology intermediary for posting loads, quoting, negotiating, booking, organizing documents, tracking and messaging. The contract of carriage is formed directly between shipper and carrier at booking; we are not a party to it. We offer no escrow and never receive freight payments.
3 · Eligibility & account
You must be 18+ with legal capacity, or an authorized representative of a lawfully existing business. Provide accurate, up-to-date information and keep your sign-in secure. Drivers are added by their carrier, who remains responsible for authorizing them.
4 · Verification
Verification is progressive: you can browse and create drafts before approval; booking, payment and quoting require an approved account. Required documents depend on your country and account type.
5 · Shipper obligations
Describe loads accurately, provide the legal documents for the cargo and corridor, have goods ready in the pickup window, enable delivery to the recipient, and pay the carrier on time.
6 · Carrier obligations
Set out in the Carrier Agreement, chiefly: valid licences and insurance, performing carriage as booked, tracking during the trip, documenting milestones and proof of delivery, and keeping cargo safe and in temperature.
9 · Prices & fees
All prices and fees are in US dollars. The fee is 3% of the agreed rate, min $25 and max $400, paid by the shipper at booking and always shown before confirming.
10 · Payment
Freight is paid by the shipper directly to the carrier: 30% at pickup and 70% after POD acceptance or auto-approval. The platform records both payments but does not guarantee them.
12 · Proof of delivery
A code sent to the recipient, their name, signature, photos, location and, for chilled cargo, the temperature log. The shipper has 48 hours to accept or dispute it, after which it is approved automatically.
13 · Disputes
Disputes are opened within 7 days of delivery. We gather evidence, give the other party 72 hours to respond and propose a settlement within 7 business days. Settlements are non-binding and we hold no money.
16 · Limitation of liability
We don't guarantee quotes or carriers and aren't liable for loss, damage or delay of cargo, which lies between shipper, carrier and their insurers. Our liability is capped at the fees you paid us in the last 12 months.
20 · Governing law
These terms are governed by the laws of [governing country]; disputes go to [competent court / arbitral tribunal], without prejudice to mandatory consumer and data protection rules.
